Changes in the Corporate Manslaughter Act 2008
The Act sets out a new offence for convicting an organisation where a gross failure in the way activities were managed or organised results in a person's death. This includes management of vehicles and drivers.Under a new approach courts will look at management systems and practices across the organisation, providing a more effective means for prosecuting the worst corporate failures to manage health and safety properly.
Driving as part of the job, is the most dangerous work-related activity performed by most employees in the UK. 95% of all road accidents are caused by human error and it is estimated that a third of accidents in the UK involve someone driving for work.
If fould guilty an organisation could be ordered to:
Pay an unlimited fine.
Take remedial action within a specified period.
Publicise nationally full details of the conviction.
Employers can no longer pass all responsibility and blame for a fatal crash onto the driver. See how a Bluecom System can help by clicking the link.
